How to register a trademark in Brazil with the INPI

In Brazil, trademarks are registered with the National Institute of Industrial Property (INPI) under Law 9,279 of 1996, and the whole procedure is conducted in Portuguese. Since December 2025 there is a single fee: it is paid once on filing and already includes the first ten years of protection, with no separate grant fee. For anyone not resident in Brazil there is a key rule: you must appoint and keep an attorney domiciled in Brazil. Brazil has been a member of the Madrid Protocol since 2019.

Is a trademark what you need to protect in Brazil?

A trademark protects the name and sign that identify your business, but it does not cover the shape of the product, the invention behind it or the creative work. In Brazil the INPI handles trademarks, patents and designs, as well as software registration; other works, such as literary works, are registered with other bodies, for example the National Library.

    Industrial design

Protects the external appearance of a product: its shape, lines or ornamentation. It does not protect the name.

Example: the silhouette of a bottle or the design of a package.

    Patent of invention

Protects a new technical solution with an inventive step and industrial application: a mechanism, a process or a product with a function.

Example: a locking system or a manufacturing method.

    Copyright

Protects works: texts, music, software, photographs or audiovisual works. It arises upon creation and registration is voluntary: in Brazil software is registered with the INPI and literary works with the National Library.

Example: the code of an app or an illustrated catalog.

Is your trademark already registered in Brazil? Registration lasts 10 years from grant and renewal costs BRL 1,000 per class. It is filed during the last year of the term, with a 6-month grace period at a higher fee. And watch out for use: if the trademark is not used for 5 years, any interested party may request its lapse (art. 143, Law 9,279).
