How to register a trademark in Guatemala with the RPI

In Guatemala, trademarks are registered with the Intellectual Property Registry (RPI), part of the Ministry of Economy, under the Industrial Property Law (Decree 57-2000). Three rules set it apart from the rest of the region: applicants domiciled abroad must act through a lawyer admitted in Guatemala; each Nice class requires a separate application; and the approved application is published three times in the official gazette, at the applicant's expense, before the opposition period runs.

Is a trademark what you need to protect in Guatemala?

A trademark protects the name and sign that identify your business, but it does not cover the shape of the product, the invention behind it or the creative work. In Guatemala a single body, the Intellectual Property Registry (RPI), handles trademarks, patents, designs and copyright, each in its own department and with its own fees.

    Industrial design

Protects the external appearance of a product: its shape, lines or ornamentation. It does not protect the name.

Example: the silhouette of a bottle or the design of a package.

Register an industrial design in Guatemala

    Patent of invention

Protects a new technical solution with an inventive step and industrial application: a mechanism, a process or a product with a function.

Example: a locking system or a manufacturing method.

    Copyright

Protects works: texts, music, software, photographs or audiovisual works. It arises upon creation; in Guatemala registration is made with the RPI Copyright Department and serves as proof of authorship and date.

Example: the code of an app or an illustrated catalog.

    Register copyright in Guatemala

Is your trademark already registered in Guatemala? Registration lasts 10 years and renewal costs GTQ 200. It can be filed from one year before expiry and, if the date has passed, within a 6-month grace period with a GTQ 200 surcharge (art. 32, Decree 57-2000). And do not forget use: a trademark not used for 5 years may be cancelled through court proceedings.
